Living-Now, Inc. - Thrive and Awaken - Membership Terms

Here are the Membership Terms for Living-Now, Inc., and its Thrive and Awaken educational program (“T&A”).  By purchasing or using a T&A Membership, you agree to the following terms and conditions, which supplement and form a part of the T&A Terms of Service. Capitalized terms not defined here have the meaning given to them in the T&A Terms of Service.

A “Member” is any individual who registers to obtain a T&A account or a free/complimentary Membership, such as a Thrive and Awaken Complimentary Membership. A “Membership Holder” is any Member who activates a T&A account and pays the fees for a Membership, such as a Thrive and Awaken Engaged Membership or a Professional Membership.

Membership Coverage. A Complimentary Membership provides you with a T&A account and access to much of the T&A website, including some aspects of the Thriving Moments, Video Blog, Thriving Tools, Inspirational Stories, and Awakening Experiences from Members & Doug J Moore, Ph.D.  You will receive emails highlighting new offerings and inspirations.

An Engaged Membership has an annual fee of $25. There is a $25 discount on the purchase of your first T&A class.  You will have the option to auto-renew annually.  A notice will be sent 30 days prior to the end of your membership to notify you to renew or of the option to auto-renew.  If you are currently enrolled in Deepening Presence®, you are automatically a Membership Holder with an Engaged Membership.  As an Engaged Member, you will be provided with all aspects of a Complimentary Membership, and access to virtual Questions and Comments with Doug J. Moore, Ph.D.

Members who register as health care service providers and pay an annual fee of $25, have the option to auto-renew annually, and are provided with a Professional Membership, including 14 days of free access to all new classes, discounts for yourself and all of your clients, patients and employees, and access to virtual Questions and Comments with Dr. Doug Moore.  “Health care service providers” includes psychologists, psychiatrists, counselors, social workers, clergy, teachers, human resource directors, coaches, physicians, nurses, physical therapists, occupational therapists, speech therapists, music therapists and the chief executive officer of a business.  Health care service providers must provide evidence of their status by providing their license, certification or a business card along with a website URL that includes their name, title, and position in the business.

Billing. Memberships have an annual term and may be auto-renewed if so selected at the time of application, or until canceled in accordance with these Membership Terms. Complimentary Members are not required to pay a fee, but must renew their membership annually.  Billing occurs at the beginning of your Membership purchase and provides access for one year thereafter. Reminder emails will be sent 30 days before your annual term expires.  You may change or terminate your Membership, using your Account Settings at the T&A website, www.thriveandawaken.com.

Account Registration. You can register by creating an account on the T&A website. All information that you provide must be accurate, including your name, address, phone and email address. You are responsible for keeping your information up-to-date and must provide changes promptly to your account, which may be accessed using your Account Settings at the T&A website, www.thriveandawaken.com. T&A’s use of your information is governed by our Privacy Policy. IN THE EVENT YOUR PAYMENT METHOD IS STORED WITH OUR PAYMENT PROCESSORS, YOU MUST PROMPTLY UPDATE YOUR PAYMENT METHOD IF YOUR PAYMENT METHOD IS CANCELED (E.G., FOR EXPIRATION, LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR USERNAME OR PASSWORD.

Cancellation of Membership. If you terminate your Membership, you may use your Membership until the end of the then-current period and your Membership will not be renewed after that period expires. However, you will not be eligible for a prorated refund of any portion of the Membership fee paid for the then-current Membership period.

Suspension/Termination by T&A. T&A may immediately terminate or suspend your T&A account, and all or a portion of your Membership, without notice if:

your payment is overdue (provided that we will use reasonable efforts to notify you of the overdue payment before we terminate or suspend);

you provide false or inaccurate information;

you violate these Membership Terms, the Terms of Service or any other T&A rules or agreements then in effect;

you engage in conduct that is a violation of any applicable law or tariff (including, without limitation, copyright and intellectual property laws); or

if you engage in conduct that is threatening, abusive or harassing to T&A employees, agents, or other T&A users, including, for example, making threats to cause mental or physical harm or damage property.

If we terminate or suspend your Membership, your license to use any software or content provided in connection with the Membership is also terminated or suspended (as applicable). If your Membership is terminated, T&A has the right to immediately delete all data, files, and other information stored in or for your account without further notice to you. You must pay all charges up to and including the date of termination.

Amount to be Charged. Membership Holders agree to pay the fees specified when you make a purchase or become a Membership Holder (plus any applicable taxes, VATs and other charges or other foreign charges).  Any agreement you have with your payment provider governs your use of your specified payment method. We may submit charges for payment and you will be responsible for such charges. This does not waive our right to seek payment directly from you.

Billing Authorization. You may be asked to provide a payment method (such as a credit, charge or debit card number) that we accept in order to activate your Membership, along with other payment information. You represent and warrant that you have the legal right to use all payment method(s) that you provide to us. Your authorizations in this section also apply to our payment processors and any other companies who act as billing agents for us. You hereby authorize us to charge your specified payment method. You authorize the issuer of your selected payment method to pay any amounts described herein without requiring a signed receipt, and you agree that these Membership Terms shall be accepted as authorization to the issuer of the payment method to pay any amounts described herein, without requiring a signed receipt from you. If you provide a debit card number instead of a credit card number, you authorize all charges described herein to be applied to such debit card unless and until you provide a credit card number.

Third-Party Payment Processors. You agree to pay us, through our payment processors, all charges at the prices then in effect for any purchase in accordance with the applicable payment terms presented to you at the time of purchase. You agree to make payment using the payment method you provide. We reserve the right to correct, or to instruct our payment processors to correct, any errors or mistakes, even if payment has already been requested or received.

Bill Inquiries and Refunds. If you believe you have been billed in error, please notify us within 60 days of the billing date by contacting us at info@thriveandawaken.com or via the T&A website, www.thriveandawaken.com. T&A will not issue refunds or credits after the expiration of this 60-day period, except where required by applicable law.
